Long story short, we had house sold and a week prior to closing (after all inspection stuff had been resolved), they come up with some bs "we can't get financing" excuse to back out (fairly certain they found another house they wanted). We got the earnest, and them to sign a release saying they breached (didn't notify before deadline) and did not act in good faith as their financing they stated in contract is not what they actually were doing (realtor and clients). We now are hopefully gonna sell for 30K less than what we had that contract for, plus, I will have incurred 3 months more worth of expenses and upkeep along with the concessions I had to make to get the house sold (easily a total of about 60K).
Do we have any sort of case? I'd love nothing more than to file this agent and her clients with a suit for our 60K or so in damages as a result of their breach.
